General Data Protection Regulation (GDPR)

We are a Data Controller of your information.

The UK Information Comissioner’s Office has their website here: http://ico.org.uk

Our legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Information we collect and the specific context in which we collect the information:

  • Our needs to perform a contract with you
  • You have given us permission to do so
  • Processing your personal information is in our legitimate interests
  • We need to comply with the law

Lawful Basis

In my case, ‘legitimate interests’ is the primary reason for processing your data. This generally includes the following:

  • Direct contact details e.g. telephone, email, for organising sessions and being able to inform you about cancellations etc.
  • Email for zoom calls.
  • Your physical address if I visit you for sessions.
  • Your emergency contact details.
  • A lot of hypnosis / trance work is about eliciting emotional states, or about avoiding “hot potato” or “triggering” subjects. This includes things like “not mentioning children if the client is unhappily childless”, “getting the gender of their spouse correct”, “knowing how to talk about the advice their parents gave them”, etc.
  • It is also extremely useful to know about a clients phobias even if I’m not doing phobia work with them.
  • Sleep habits are also extremely relevant to my work with clients.
  • Smoking, alchohol and caffeine consumption information is also extremely useful for my work with clients even if I’m not working on those issues with that client, because they effect stress which effects everything else we do.

The DUAA (2025) has now added ‘recognised legitimate interests’ lawful basis. When you use personal information for certain ‘recognised legitimate interests’ it removes the need for you to balance the impact on an individual against the benefits of that use e.g. when protecting public safety. For example, the change now allows you to give personal information to organisations such as the police without you having to make a judgement about the necessity. The organisation making the request is responsible for this decision.

Personal data that we process shall not be kept for longer than is necessary. We will retain and use your information to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our policies.

If you are a resident of the UK or European Economic Area (EEA), you have certain data protection rights. If you wish to be informed what Personal Information we hold about you and if you want it to be removed from our systems, please contact us by email.

Your Rights

In certain circumstances, you have the following data protection rights :

  • The right to access, update or to delete the information we have on you.
  • The right of rectification.
  • The right to object.
  • The right of restriction.
  • The right to data portability
  • The right to withdraw consent

Data Protection Complaints

You should contact me via my email or via the website contact form if you have any complaints about how I have used your data.

The DUAA (2025) clarifies that I only need to make ‘reasonable and proportionate’ searches when someone asks for access to their personal information. I am not required to check every single document/email, etc. if the information is unlikely to contain relevant data or is disproportionately difficult.
